Terms of Use

Note: these Terms cover the use of the Cosmic Production mobile + web apps as software. The actual rental contract — what you legally agree to when renting gear — is the separate Rental Agreement you sign via magic link before pickup. The booking request you submit in the app is an inquiry, not a binding rental.

1. Who we are

Cosmic Production d.o.o. is a Croatian limited liability company based in Split that rents AV equipment, books DJs, and produces events. These Terms govern your use of our apps; they do not replace the Rental Agreement you'll sign before any gear leaves the warehouse.

2. Account

You may create an account to send booking requests and review your booking history. You're responsible for keeping your sign-in credentials secure. One person, one account; don't share your account with others.

4. Booking inquiries

A booking submitted via the app is a request. It becomes binding only when we send you a final quote and you sign the Rental Agreement (digitally via the magic link we email you, or on paper at pickup). We may decline a booking for availability, logistics, or any other reason.

5. Pricing

Daily rates displayed in the app are indicative. Final pricing — including multi-day discounts, delivery fees, and operator hire — is confirmed on the quote we send before you sign the Rental Agreement.

6. Payment

Invoice on delivery, payable by bank transfer (IBAN) or cash at handover, as agreed in the Rental Agreement. We don't process card payments through the app itself.

7. Damage and loss

Standard rental terms apply per the Rental Agreement. The signed agreement includes the deposit, replacement-cost schedule, and damage assessment process.

8. Worker / employee use

If you're using the app as a Cosmic Production team member (field worker, manager, office staff), your access is governed by your employment relationship. The check-in geolocation feature is used solely to verify on-site presence at events you're personnel for. Your manager has access to those check-in records.

9. Availability and changes

The app is provided "as is". We may change features, add new functionality, or remove old surfaces. We'll give reasonable notice for changes that affect existing bookings.

10. Liability

To the maximum extent permitted by law, our liability for app-related matters (separate from the Rental Agreement liability) is limited to the booking amount in dispute. Nothing here limits liability for gross negligence or wilful misconduct, or any rights you have under Croatian consumer-protection law.

11. Governing law

These Terms are governed by Croatian law. Disputes go to the courts of Split, Croatia.
